We assisted the client to achieve consensual financial provision settlement terms with her husband who had been quite hostile and fractious with her during the latter stages of the marriage at least and who had a slightly abrasive and combustible personality. We achieved a better than expected set of settlement terms including a healthy majority share of the net proceeds of sale of the former matrimonial home, a half share of the husband’s tax rebate and a significant share of the major pension asset (of the two that he held).

This pension asset included Defined Benefit and Defined Contribution elements and great care had to be taken to make sure that a full and proper description of the pension to be shared, was set out in the Consent Order and Pension Sharing Annex. Communication with the pension administrators was difficult and the quality of information provided by them, sub-optimal, hence a risk of an incorrect pension share being secured. In any event the correct, generous pension share was secured and the Consent Order and Pension Sharing Annex swiftly and fully approved by the Court.
